Thank you for shopping with Mister Backyard. In these Terms, "we", "us" and "our" mean Mister Backyard, operated by Acerbus LLC. We run this online store, together with its content, tools and the products we offer (the "Services"), and the store is built on Shopify, the platform that makes the Services possible.

These Terms of Service explain what you can expect from us and what we expect from you when you use the Services. They contain important information about your rights, including how our liability is limited where the law allows, so please read them carefully.

By browsing, buying from or otherwise using the Services, you agree to these Terms and to our Privacy Policy. Anyone who does not accept them should stop using the Services.

Section 1 – Using the Store and Your Account

To accept these Terms you must be at least 18 years old. Your account is personal to you and cannot be sold, transferred or handed over to someone else. Keep your login details safe: you are responsible for anything done through your account.

Section 2 – Product Information

We work hard to describe and photograph every product accurately. Screens display colours differently, though, so the finish you see online may look slightly different in person, and some lifestyle photos show the product in a styled setting with items that are not included. The listed contents of each product are set out in its description. We may update product information, limit the quantities available or stop selling a product at any time.

Section 3 – Placing an Order

Submitting an order is an offer to buy the products in your cart. Mister Backyard may accept or decline an order, and an order is only accepted once we have confirmed it and received payment. Please check your order details before you submit them. Returns and exchanges are handled under our Refund Policy.

Section 4 – Prices and Payment

Prices are shown in Australian dollars (AUD) and may change at any time, but the price you pay is the one shown when you place your order, which is the amount stated in the email we send to confirm your order. Free standard shipping on all orders. All prices include any import duties and taxes, so nothing more is charged at checkout or on delivery. We accept Shop Pay, Visa, Mastercard, American Express, Diners Club, Discover, Apple Pay, Google Pay and PayPal. You agree to give us accurate payment details and to keep them up to date.

Section 5 – Delivery

Delivery times are estimates, as explained in our Shipping Policy: processing takes 1–2 business days and delivery is estimated at 7–14 business days from the order date. Carriers and events outside our control can occasionally cause delays. We remain responsible for your order until it is delivered, and if a parcel is lost or damaged in transit we will replace it or refund you as set out in our Shipping Policy.

Section 6 – Intellectual Property

Everything on the Services, including our name, logo, text, photos, graphics, videos and the way they are arranged, belongs to Acerbus LLC or to those who license it to us, and is protected by intellectual property law. You may not copy, republish, adapt or share any of it without our written permission. Any rights not expressly given to you are reserved.

Section 7 – Third-Party Tools

We may give you access to optional tools supplied by other companies. These tools are offered as they are, without any promise or endorsement from us, and you use them at your own discretion.

Section 8 – Links to Other Websites

The Services may link to websites run by other people. We do not control those websites and are not responsible for their content or how they operate, so please review their own terms before relying on them.

Section 9 – Shopify

The store runs on Shopify, but every purchase you make is a contract between you and Acerbus LLC. Shopify is not a party to that contract and is not responsible for the sale, and you agree not to bring claims against Shopify or its affiliates about it.

Section 10 – Your Privacy

Any personal information you give us through the Services is handled under our Privacy Policy, which forms part of these Terms.

Section 11 – Reviews and Feedback

If you send us reviews, photos, suggestions or other feedback, you allow us to use, copy, edit and publish them, without payment, in any media and for as long as we wish. Please only send material that belongs to you or that you are allowed to share.

Section 12 – Mistakes on the Store

Despite our care, the Services may sometimes include a typing mistake, an incorrect price or missing information. We may fix these errors at any time and, if an order was placed on the basis of incorrect information, we may cancel it and refund you in full.

Section 13 – Acceptable Use

Use the Services lawfully. You must not use them to break any law, infringe anyone's rights, abuse or threaten other people, upload harmful code, collect other people's data without their consent, or interfere with the store or its users. We may suspend or end access for anyone who does.

Section 14 – Ending Access

We may stop providing the Services to you at any time. Any amounts you owe remain payable, and the sections on intellectual property, disclaimers, limitation of liability and indemnity continue to apply after access ends.

Section 15 – Disclaimer

Except as stated in these Terms and to the extent permitted by law, the Services are provided on an "as is" and "as available" basis, and we give no additional promises beyond those the law requires. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL), including the consumer guarantees that cannot be excluded by law.

Section 16 – Limitation of Liability

To the extent permitted by law, Acerbus LLC and its officers, employees, agents and suppliers are not liable for indirect or consequential loss, such as lost profits or lost data, that results from using the Services. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL), including the consumer guarantees that cannot be excluded by law.

Section 17 – Indemnity

You agree to cover any claims, losses or costs that Acerbus LLC, Shopify and their staff, agents and partners incur because you broke these Terms or the law. This does not apply to the extent that a loss was caused by us.

Section 18 – If Part of These Terms Is Invalid

If a court finds any part of these Terms unlawful or unenforceable, that part will be removed and the rest of the Terms will still apply.

Section 19 – The Whole Agreement

These Terms, our Privacy Policy and the other policies they refer to make up the full agreement between you and us about the Services and replace any earlier arrangement.

Section 20 – Governing Law

These Terms are governed by the laws of the State of Wyoming, United States. If you are a consumer in Australia, this does not take away the protection of the mandatory laws of your state or territory, and you may also bring a claim in the courts where you live. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL), including the consumer guarantees that cannot be excluded by law.

Section 21 – Changes to These Terms

We may update these Terms when our services or the law change. The current version will always be published on this page, and we will notify you of changes where the law requires it. Using the Services after an update is published means you accept the new version.
