Mister Backyard respects the intellectual property of others and expects the same from everyone who uses our store. This policy explains how we protect our own content and how rights holders can report material they believe infringes their rights. As Mister Backyard is operated by Acerbus LLC, a United States company selling to customers in Australia, we handle reports in line with the United States Digital Millennium Copyright Act (DMCA) and the Australian Copyright Act 1968 (Cth).
1. Our Content
The Mister Backyard name and logo, our product photography, descriptions, graphics, page layouts and other original material on this website belong to Acerbus LLC or are used with permission from their owners. They may not be copied, reproduced or reused without our written consent.
2. Respecting the Rights of Others
We do not knowingly use or sell material that infringes copyright, trade marks or other intellectual property rights. If you believe something on our store uses your work without permission, please tell us and we will look into it promptly.
3. How to Report an Infringement
Send your notice by email to contact@misterbackyard.com with the subject line "IP Notice". To help us act quickly, please include:
- your full name, postal address, phone number and email address;
- a description of the copyrighted work, trade mark or other right you believe has been infringed;
- the exact web address (URL) of each page on our store where the material appears;
- a statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law;
- a statement that the information in your notice is accurate and that you are the rights holder or authorised to act on their behalf;
- your physical or electronic signature.
We acknowledge every complete notice within 24 hours on business days. Where a notice is valid, we will remove or disable access to the material concerned and let the person who supplied it know.
4. Counter-Notification
If material you supplied was removed and you believe this was a mistake or that you have the right to use it, you may send a counter-notice to contact@misterbackyard.com. Please include:
- your full name, postal address, phone number and email address;
- identification of the material that was removed and where it appeared before removal;
- a statement that you believe in good faith that the material was removed by mistake or misidentification;
- your consent to the jurisdiction of the appropriate court for your address, and your physical or electronic signature.
We will forward the counter-notice to the person who made the original report. Unless they tell us they have started legal proceedings, we may restore the material within 10 to 14 business days.
5. Repeat Infringement
We may suspend or close the account of anyone who repeatedly infringes the intellectual property rights of others.
6. False or Misleading Notices
Please make sure a report is accurate before you send it. Knowingly submitting a false notice or counter-notice may expose you to legal liability for any damage it causes.
